Also, they have to make the ban align with the goal of national security or they'll get bounced on Establishment Clause basis. The targeted countries aren't associated with actual terrorist attacks on U.S. soil...prevention of which is the goal.

in order for any eo to succeed, it must avoid depriving due process under the law from those to whom the right attaches. It attaches to anyone with legal right of entry into the U.S. Cutting off legal entry without due process = unconstitutional.
