My understanding is that they were waiting to see if a federal appeals court would uphold the state ban. The idea being that there would then be a discrepancy between two courts, and the Supremes would weigh in to resolve the conflict.

I think that's more the rationalization for it. If there were a discrepancy it forces their hand more but even then, they can do whatever. I think this is the better way to go, cuz it allows things to happen a bit more organically.

What's being litigated is whether or not the bans on gay marriage are constitutional. If it's been decided that they aren't constitutional, (and yeah, that's indeed the way it has been decided), then yes the Federal government has that power .

Also originally nothing in the Bill of Rights applied to the states, it was only to the Federal government. It says Congress shall not do this and that, there's actually nothing about whether the states are allowed to.

But that's not how it's adjudicated today. Even though the Bill of Rights in the Constitution only mentions Congress, many (but not all) are applied to what the states do as well.

Marriage as defined in 1978 was more of a right. Still isn't an actual civil right. It has obviously changed in definition since then. Any judge trying to make parallels based off that Milwaukee case would be laughed at. U.S. v. Windsor (i think)

Polygamy would present other issues too: who gets parental authority, makes medical decisions for another spouse, gets what share of govt benefits... the list goes on and on. For those reasons I don't think polygamy is on that slippery slope.
